Reorganization
Workx (re)organizes: clarity in challenging times
In a reorganization, dismissals are sometimes unavoidable. In legal terms, there are a multitude of rules to take into account. At Workx advocaten, we know exactly what is needed and what scenarios may arise. Our lawyers have a great deal of experience with reorganizations, from large-scale collective layoffs to small organizational changes. We make it clear.
Step 1: Thorough preparation
We are happy to help with the preparations:
- Collecting and organizing the information and mirroring of employees
- Preparation of a practical plan of action.
- Drafting the communication to staff, the works council, trade unions and the Employee Insurance Agency (UWV).
Good preparation is half the work.
Step 2: Involvement of the employee representation
The works council plays an important role in reorganizations and must be involved in the decision-making process in a timely manner. This is not only required by law, but our experience has taught us that it also creates support and trust. Ultimately, it is about being able to implement decisions quickly and carefully. We can help streamline this process.
In addition to the works council, trade unions can also play a role. For example, if this follows from a collective labour agreement or in the case of a collective dismissal of 20 or more employees. We are happy to help with communication and meeting the obligations in this regard:
- Informing the trade unions and works council.
- Drafting requests for advice.
- Guiding advisory processes and discussions with the works council and unions.
- Advising and negotiating a social plan.
Step 3: Careful implementation
Many employers prefer dismissal via a termination agreement. This prevents legal proceedings and offers quick clarity. We help you with:
- Drafting termination agreements and clear communication to employees.
If an employee does not agree to a termination agreement, we will assist with a UWV procedure. Our approach ensures that you always have a full plan B in reserve.
Contact Workx advocaten and discover how we can guide your reorganization in a smooth and professional manner. Together we will ensure clarity and a sustainable approach.
